How to get around this guy...

Hey guys, just started my playthrough (remember the awesome/terrible Independence Day video? ;) And I'm not sure how to get around this mercenary without either a. getting arrested or b. killing him and having THIS happen (at the end of the video)... Should I just get arrested? Your help is legendary! :)

    I forget the middle part but its something to let him know your not bandits and hunting them

    It's not always possible. If you fail a reaction check (based on your reputation and the charisma of the person talking to him) then you do not get the dialogue options to avoid the fight. You need a really low charisma and rep though, as it is an easy roll.
