[Bug] Paws of the Cheetah backstab.

Anyone know or have the problem with Paws of the Cheetah and a pure thief or assassin coming out of stealth with no attack roll being made?
current behavior: With item equipped stealth is broken with no attack roll being made. It does not always happen but the rate is 50% of the time the backstab is wasted.
expected behavior: To break stealth with an attack roll being made.
