The above is not true.

This still occurs. I started a new game and I looted a container in Beregost in someone's house. Some NPC walked from fog of war back into non fog of war area and alerted the guards right away!

    This happened to me in the Duchal Palace after the 1st encounter with Sarevok. Didn't even open the chest in the room where you fight the Greater Dopplegangers, just checked to see if locked which it is, and I got the "The Guards have been summoned" dialog.

    The first can happen, i guess (if there is only little time passed). But the second is really interesting.
    Could you give area code/location?
