Mulahay Fight issue

Hi,
Problem[OS : WindowsXP, Language : German, Version : 1.2] :
If you got mercy to Mulahay and don't kill him he stays( won't go away ).
When you open his treasure he again turns hostile and a new bunch of minions spawns around you( even more then the first time for me ).
Solution:
1. You should not get the option to let him go away( in the short cutscene next the narrator tells us, that you killed Mulahay anyway ).
2. You have mercy, but Mulahay should vanish and you should be safe.
