(v1.2) BUG? - Nashkel Mines - Mulahey keeps attacking after surrender

I did NOT start a new game after updating to 1.2. That being said, when I begin the discussion with Mulahey, I choose the first option pretending Tavok sent me. He says "fine, read the letters in the chest and take them" (or something similar) and stands down. As soon as I click on the chest, he forgets what he just said and attacks. After some damage, he asks for surrender. I choose to have mercy and he thanks me and tells me to have what is in the chest (again). I click on the chest and he attacks again until I kill him, with kobolds and skeletons respawning.
