Legacy of Bhaal restrictions

Don´t know if this is intended or not, but when trying to create a game with the missus with the Legacy of Bhaal difficulty setting it automatically downgrades it to Insane once the second player joins and the difficulty can be altered in game to anything BUT Legacy. Any fixes for this?

    I have an issue with the same thing happened re: downgrading to insane mode, but it doesn't have to be multiplayer for it to happen. Seems it just happens after a certain amount of time. I'm on Mac OS on Steam.
