Simulacrum Problem

My protagonist is unable to create a simulacrum with Vhailor's helm, as the simulacrum dies instantly. All other characters in my party that can wear a helm can create a simulacrum with it. I suspect the problem lies with the manner in which the simulacrum's level is calculated, as my protagonist is a 38th level thief/8th level cleric (advancing in cleric). If the clone's level works out to less than 1, it would obviously die upon creation.

Can anyone confirm this? Is this intended behavior or should I report it as a bug? If this is a bug, does anyone have a workaround? I don't mind modifying game files to get this to work. I really need Vhailor's helm, as I'm soloing BG2 in LOB mode.
