    In a bankruptcy situation where the estate is being liquidated, it is the obligation of the trustee to get maximum return for the assets of the estate. This could be selling off individual assets (like BG) or selling them off as a package with other assets. The trustee should approve whichever will get the biggest return for Atari's creditors.

    If Atari U.S. is just doing this to try to free itself from the parent Atari in France, then they might not lose control of anything. Or much that is of value. Who knows what kinds of maneuvering this involves if that is their primary goal. In that case they would undoubtedly be trying to hold onto everything valuable.

    Most companies don't lose their rights to their intellectual property in bankruptcy - they go through bankrupty, emerge with a reduction in their liabilities, and the successor company owns the IP.

    I don't think the question is whether they'll lose the rights so much as whether or not they'll be more amenable to selling those rights.

    The issue is really what level of going concern they are planning to be. In most cases, there isn't much change but I am sure this is what Beamdog is exploring.

    Imo, whether Atari loses it or sells BG, I just hope a company that's respectful to its customers gets it. That they are tolerant with Beamdog/Overhaul and don't ruin the franchise. So essentially not EA or Activision. XD

    Atari filled chapter 11 bankrutcy so it will not be shutting down. with a totle debit of 10-50m this is not even a large bankruptcy. Once it is seprated from info games. atari will easly be abel to pick up venture capital to become solvent.

    Afaik the EE actually revived the BG IP quite nicely. There's lots of talk about new projects involving it, as the response and reception of the EE has been quite positive.

    Even if Atari goes under, it just means someone else will pick up the rights. And I'm pretty sure someone will!

    @ScytheKnight: I'm going to pretend I didn't hear that...

    Just the thought of that... VD of a company getting hold of it... *retches*
