Being caught stealing when far away from looted chests

I'm pretty sure this is already being / has been addressed (think I've seen it mentioned but can't find the reference right this moment) but just in case I'm mentioning it here.
When you pick a locked chest and dig around in it (container GUI open) and are 'seen', i.e. a commoner is in line of sight of your crime, they alert a Flaming Fist grunt and when you are unseen you get away with it; all well and good so far. However, if you loot the chest, walk away (GUI closed) and then the commoner sees you they still alert the guard. This would be fine if it wasn't for the fact that if you save after looting (before being spotted) and reload, the crime goes unnoticed (as it should do IMHO!)

    Well, actually the commoners call the guards when they see the looted chest and not when they see you after looting a chest. What is really happening is the commoners are wandering around off screen and when they wander within visual range of the chest they see that it has been looted and call the guards. What you can do to get away with stealing is quickly change areas before the guards come or before they call the guards. If you change areas they can't call the guards and the guards won't appear if they were called, even if you go back into the area where you were stealing. So if you saved after stealing and the guards come when you load, then quickly move your entire party to a different area; either by changing floors or leaving the house or whatever you are in.

    This is the intended behavior and it shouldn't be changed.

    I don't like that as a personal preference but I'm saying I'm reloading and even if they see the chest looted then on that reload they don't react. I kind of regret bringing this up now what with me not agreeing with the intended behaviour!
