Disintegrate's item destruction can be bypassed by turning off gore

As the title description says in BG2 (and BGEE) the 6th level mage spell disintegrate can have its destructive effect on items (other than gold and quest items) bypassed by turning off the "gore" setting under gameplay options (this also applies to enemies who have been frozen or petrified).
In the case of disintegrate the spell description states "when this spell is cast at another creature, a thin green ray is shot out. Upon contact with the ray, the creature must make a Saving Throw vs. Spell or be transformed into dust. This transformation is instantaneous and irreversible. There is also a good chance that this will destroy some if not all the items the creature is carrying."
At least to me and @Tresset this sounds like more than just an exploit but an actual bug. Spells should work the same regardless of whether gore is active or not.
