GemRB is an open-source clone of the Infinity Engine. It does not use any of the original IE code.

Beamdog's Infinity+ Engine is built on the original IE code, heavily rewritten, modified, and extended by Beamdog.

The GemRB engine is not owned by Beamdog, Bioware, or Hasbro. You could use it to build a game, but all the art assets (backgrounds, sprites, gui elements, sounds, etc..) from the original games ARE owned by Hasbro/Bioware/Beamdog. So, you'd have to build all the art assets from scratch if you wanted to create your own independent game.

Probably not enough for a whole game

Also, it is worth to mention that just as D&D and Forgotten Realms are owned by WotC, campaing worlds can be owned by other entities.

Some, at sites like http://opengameart.org/. But not enough to replace all the Infinity Engine art assets (you'd also need to convert to IE formats).
