The original Cards Against Humanity game is copyrighted with a Creative Commons license. This means that it’s completely permissible to create your own decks and share them with your friends or online — so long as you don’t try to make any money off of it, of course.
Nevertheless, the site https://www.cardcastgame.com offers printed cards for $18.99.
So, using the "Baldur's Gate" trademark (words) in these cards would be a violation.
Baldur's Gate, Dungeons & Dragons, D&D, Forgotten Realms, Balder's Gate, Wizards of the Coast and their logos are trademarks of Wizards of the Coast LLC in the U.S.A. and other countries, and are used with permission.
So, these cards should be deleted.
It could stay only as a forum thread idea, I think.
Maybe I can find a different website that doesn't offer prints ...
Anybody know a anything?
PS: There doesn't seem to be an option to disable prints on the website and I can't find any other website that offers this service I contacted them on twitter and via email now, let's hope for the best.
Ok, so an update:
I just got message back, they are saying that they are only blocking cards/ decks from print if the copyright holder themselves message them about it. So ... now what?
However, on the legal point ... if the site shares the revenue from printing cards with whoever contributes the designs, then indeed the contributor would be making a commercial gain and could be liable when WotC sues for unlicensed use of its trademarks. However, if the site keeps all the revenue for itself, then I think the liability would fall only upon the site as publisher, not upon the contributors who designed the cards. On the other hand, this sort of issue is something on which laws vary from one country to another, so maybe there's some jurisdiction somewhere in which the site's contributor could also be sued.
Recommence thread fun!
White card: She's your sister!
First and foremost, we received a takedown request for two decks (BTQD2 and NH5PW) and we'll be removing them. It is my belief that the decks would fall under fair use (CaH itself has the cards "Darth Vader", "Harry Potter erotica" and "RoboCop" to name a few). Anyhow we're not out to upset anyone, so if your community wants the deck gone, that's fine.
That said, I would like to clear up one misconception in this thread. Cards Against Humanity has released their cards under a Creative Commons License, not the game or the concept of the game. That is to say, the content of the cards, not the concept of the game itself. The rules/play of the game (which were heavily borrowed from Apples to Apples) are not subject to the Creative Commons license.
This is plainly evidenced by several professionally printed "knock off" expansions/apps, all operating legally. Take a look at Crabs Adjust Humidity or Cocks Abreast Hostility or the app Evil Apples. Heck, Crabs can even be purchased at your local Barnes and Noble (the 3 or so left in the world). Cardcast sells cards in a similar way. The only difference is that they're user-generated. Because of that, we strive to pick out any copyrighted card, and if the deck contains too many, we prevent the deck from being printed at all.
Thanks for hearing me out. Happy New Year to all of you.
